"WITHBOX" Rights Statement & User Service Agreement

Please carefully read and fully understand this document before using "WITHBOX" products and services. Continued or initial use constitutes your acceptance of all terms.

Preamble & Introduction

Welcome to "WITHBOX" services.

To access "WITHBOX", you must agree to the WITHBOX Rights Statement and User Service Agreement. Read these terms diligently, especially clauses on liability limitations, jurisdiction, and applicable laws. Key restrictions may be highlighted in bold or underlined. Usage of "WITHBOX" services implies your acceptance of these terms.

If you are under 18, review this agreement with a legal guardian and pay special attention to the minor-use provisions.

1. About "WITHBOX"

1. "WITHBOX" (hereinafter referred to as "WITHBOX") is a private cloud product brand by AINEST TECHNOLOGY PTE. LTD. It features advanced craftsmanship, security, multi-functionality, energy efficiency, and eco-friendliness. WITHBOX automatically backs up photos, videos, and files from your phone, computer, or tablet to your private storage, safeguarding precious memories and critical data.

2. Data Privacy: Protecting user data is core to WITHBOX. Without explicit user consent, WITHBOX does not access, modify, edit, or store uploaded content, except as required by law.

3. Security Measures: WITHBOX employs safeguards to protect stored content and user information, continuously improving services (e.g., personalized features, enhanced security).

4. Copyright Compliance: WITHBOX respects copyright laws (e.g., Regulations on the Protection of the Right to Network Dissemination of Information). We review user-shared content. If violations are found via reports/notices, WITHBOX may:

• Require corrections, or
• Take actions (e.g., block content, suspend services) to mitigate harm.

To report infringement, email admin@ainest-tec.com with:

• (1) Alleged infringing content’s name/address.
• (2) Your contact details (email preferred) for verification.
• (3) Evidence of infringement.
• (4) Statement: "I believe the use of copyrighted material on the cited page is unauthorized."
• (5) Statement: "I certify the accuracy of this notice and am authorized to act on behalf of the rights holder. False claims will be punished."
• (6) Signature.

Note: Legal notices may be shared with third parties. Users falsely claiming ownership may be liable for damages (including legal fees).

5. Intellectual Property (IP): All text, graphics, audio, video, interfaces, code, and documentation in WITHBOX are owned by AINEST TECHNOLOGY PTE. LTD. and protected by IP laws. No transfer of ownership occurs through use.

6. Trademarks: WITHBOX designs, names, and logos are trademarks of WITHBOX or affiliates. Unauthorized use is prohibited.

7. Content Restrictions: Without prior written consent, no media/person may reproduce, adapt, or commercialize WITHBOX content (including graphics, layouts, programs). Violators bear legal risks; WITHBOX disclaims liability for third-party misuse.

8. Copyright of This Agreement: Reserved by WITHBOX, with sole rights to amend/interpret.

2. User Service Agreement

2.1 Acceptance & Amendments

1.1 This agreement binds users and AINEST TECHNOLOGY PTE. LTD. (hereinafter "WITHBOX"). By accessing/using services, you accept all terms. Refusal to accept terms prohibits service use.

1.2 WITHBOX may amend terms due to legal/regulatory changes or service updates. Changes will be posted on our website. Users disagreeing with amendments must stop using services. Continued use post-amendment constitutes acceptance.

1.3 This agreement, along with supplementary policies (e.g., rules, guidelines), forms a complete contract. Users agree to these supplements by using services.

1.4 Services include:

• (1) WITHBOX clients (PC, mobile, TV, etc.).
• (2) Other WITHBOX technologies/services.

1.5 Minors must review with guardians; their actions imply parental consent.

1.6 Key clauses (bolded) are not "unfair" under contract law. You acknowledge their validity.

2.2 Account Rules

2.2.1 Registration

• Provide accurate, valid information. Misrepresentation or inactive updates may lead to account suspension. WITHBOX reserves the right to pause/terminate services (excluding basic storage).
• Account names must comply with laws. Prohibited: illegal content, impersonation of entities/public figures.

2.2.2 Login

• Use your registered username/email/phone + password. WITHBOX may freeze services if security risks are detected.

2.2.3 Account Custody

• You own limited usage rights; WITHBOX retains ownership.
• Responsibility: Secure your account. Losses from leaks/negligence are yours.
• Prohibited: Transferring/selling accounts. Unauthorized use makes you liable. WITHBOX may verify identity (e.g., CAPTCHA, SMS). Failed verification may result in service suspension.
• Lost Accounts: Follow official recovery steps. Incomplete/invalid proof may cause failure.

2.2.4 Account Deletion

• Delete via online request or email (admin@ainest-tec.com). Data (cloud records, points) will be erased/anonymized.
• Admin accounts: Call +65-80603168 (processed in 5 business days).

2.3 Service Conduct

2.3.1 Compliance

• Obey laws (e.g., National Security Law, Copyright Law, Cybersecurity Law). Prohibited:
• Harming national security, spreading illegal content (violence, pornography, hate speech).
• Infringing others’ rights (privacy, IP).
• Disrupting social order.
• WITHBOX may terminate services without notice for violations.

2.3.2 Authorized Access

• Only use official channels. Illegally obtained services (accounts, downloads) are void.

2.3.3 Service Boundaries

• Services are for WITHBOX use only. Unauthorized modifications/separations are prohibited.

2.3.4 Advertising

• WITHBOX/Affiliates may display ads (scope/methods may change). You consent to promotional emails.
• Disclaimer: Verify ad accuracy. WITHBOX is not liable for ad-related losses.

2.3.5 Prohibited Actions (Partial list):

1. Storing/harassing content (illegal, hateful, pornographic, violent, etc.).
2. Harming minors.
3. Impersonating others.
4. Misleading content attribution.
5. Distributing unauthorized materials (confidential, patented).
6. Spamming (except designated areas).
7. Spreading malware/viruses.
8. Attacking WITHBOX servers/networks.
9. Using bots to scrape data.
10. Reverse-engineering WITHBOX software.
11. Creating fake accounts/devices for rewards.
12. Modifying copyright notices.
13. Using WITHBOX IP unlawfully (e.g., plugins, hacks).
14. Sharing personal data without consent.
15. Violating local laws.
16. Non-human automation (banned permanently).
17. Content risks (illegal, offensive, harmful).
18. Liability: You bear all consequences of violations, including legal costs.

2.3.6 Amendments

• WITHBOX may update WITHBOX. Continued use post-update implies acceptance.

2.3.7 No Resale

• Prohibited: Profiting from account/data trading. Violators face service termination/legal action.

2.3.8 No Endorsement

• WITHBOX does not guarantee content accuracy. Users bear risks of exposure to inappropriate material.

2.3.9 User-Generated Content

• You are liable for content you upload/share. WITHBOX may block infringing content without notice.

2.3.10 Legal Compliance

• Ensure your content does not violate laws (e.g., national security, defamation). WITHBOX may remove non-compliant content upon notice.

2.3.11 Cookie Use

• Cookies (anonymous) enhance personalized services. Disable them via browser settings, but some features may not work.

2.3.12 Special Exemptions

• WITHBOX stores registration data for service improvement. Update info promptly; inaccuracies are your responsibility.

2.3.13 Stored Content

• User-stored content (videos, files) is for personal use. WITHBOX is not liable for third-party claims arising from such content.

2.3.14 Intellectual Property

• WITHBOX owns all service-related IP (software, trademarks, etc.). Users may not reverse-engineer, modify, or distribute WITHBOX software/IP.

2.4 Privacy

WITHBOX prioritizes privacy. Review our Privacy Policy (contact admin@ainest-tec.com for details). Key points:

• Data collection/use, cookie practices, sharing disclosures, user controls, and protection measures.

2.5 Liability Limitations

• WITHBOX does not guarantee uninterrupted/secure services or compatibility with all devices.
• Users bear risks of data loss due to personal actions (e.g., improper storage).
• WITHBOX is not liable for indirect/damages (e.g., lost profits, data corruption) except as required by law.

3. Termination & Amendments

• WITHBOX may suspend/terminate services for violations/risk mitigation. Users are responsible for data backups.
• Changes to terms take effect upon posting. Continued use implies acceptance.

4. Governing Law & Dispute Resolution

• This agreement is governed by SGP law. Disputes shall be resolved by the Singapore International Arbitration Centre,SIAC mmission (final ruling).

5. Miscellaneous

• WITHBOX reserves the right to interpret this agreement.
